(hereafter also referred to as “Happy Returns,” “we” and “us”) collects, uses, maintains and discloses information collected from users (each, a “User”) of happyreturns.com (hereinafter “site” or “website”) or the Happy Returns live kiosks (hereafter “Return Bars”) (together, collectively the “Service”). By accessing the Service, you acknowledge and agree to this Privacy Policy and also agree to the User Terms located at: www.happyreturns.com/terms

We reserve the right to make any changes to our privacy policy at any time, notice of which may be posted on this privacy page at www.happyreturns.com/terms. Users must refer back to our privacy policy to read any changes in our privacy policy.

Information Collection

While using the Service, you may be asked provide us with certain personally identifiable information in order to process a return for a merchant website. This refers to information about you that can be used to contact or identify you, and information on your use of and activities at Happy Returns (“Personal Information”). Personal Information that we collect may include, but is not limited to, your name, order content, delivery and billing information, and email address. We don’t collect your credit card information; this information is collected and used by your original merchant for your purchase and any refunds you are due. Personal Information may also include information you submit to the Service or website when you make an inquiry or seek additional information from us.

When you visit Happy Returns, our servers automatically record information that your browser sends whenever you visit a website. This information may include, but is not limited to, your computer’s Internet Protocol address (IP address), browser type, and the web page you were visiting before you came to Happy Returns. Personal Information is used to fulfill return requests you may make; to verify your original purchase and obtain return authorization from your merchant; to provide and improve our website and services; to better understand your needs and interests; to personalize your experience; to provide or offer software updates and product announcements; and to provide you with further information and offers from us that we believe you may find useful or interesting, including newsletters, marketing or promotional materials and other information on services and products offered by us or third parties that are authorized by us.

Information is gathered to monitor and analyze use of Happy Returns and our services, for technical administration, to increase our site’s functionality and user-friendliness, to better tailor it to your needs, to generate and derive useful data and information concerning the interests, characteristics and website use behavior of our users, and to verify that the proper information is submitted to fulfill and process your returns.

Merchants, Service Providers, Business Partners and Others

Happy Returns partners with third party merchants to facilitate the return of a user’s online purchases from those third party merchants at our Return Bars. Due to the nature of our business model, when an affiliated business is associated with your transaction, we may share information that is related to such transaction with or through that affiliated business. Happy Returns may also share aggregated demographic information with our business partners.

Happy Returns does not control the privacy policies of third parties, and you are subject to the privacy policies of those third parties where applicable. Happy Returns is not responsible for the privacy or security practices of other websites on the Internet, even those linked to or from the Happy Returns site. We encourage you to ask questions before you disclose your personal information to others.

We may employ third party companies and individuals to facilitate our service, to provide service on our behalf, to perform website related services (including but not limited to maintenance services, database management, web analytics and improvement of Happy Returns’ features) or to assist us in analyzing how our website and service are used and can be improved. These third parties may have access to your Personal Information only for purposes of performing these tasks on our behalf.

Compliance with Laws and Law Enforcement

Happy Returns must cooperate with government and law enforcement officials and private parties to enforce and comply with the law. In the event of a claim and/or legal process (including but not limited to subpoenas), to protect the property and rights of happyreturns.com or a third party, to protect the safety of the public or any person, or to prevent or stop any activity we may consider to pose a risk of being illegal, unethical, inappropriate or legally actionable, we reserve the right to disclose any information about you to government or law enforcement officials or private parties as we in our sole discretion find necessary or appropriate.

Business Transfers

In the event of a bankruptcy, merger, acquisition, reorganization or sale of assets, Happy Returns may sell, transfer or otherwise share some or all of its assets, and your Personal Information may be transferred as part of that transaction. To the maximum extent allowable by law, the Privacy Policy will apply to the User information as transferred to the successor entity. However, User information submitted after a transfer to a successor entity may be subject to a new privacy policy adopted by the successor entity.

Security

Happy Returns takes the security of your Personal Information seriously. We will employ reasonable measures designed to protect your information from unauthorized access and unsolicited contact from third party groups. To that end, all sensitive personal information (credit card data) is transmitted through secure networks supported by high-grade 256-bit encryption. Credit card numbers are not stored or held on our servers.

Minimum Age Requirement

Happy Returns is not directed to nor is it intended for individuals under the age of 18. We do not knowingly collect personally identifiable information (or any information at all) from any persons under 18 years old. If we become aware that an individual under the age of majority has provided us with Personal Information, we will delete such information from our files. Users of Happy Returns accept responsibility of ensuring that minors are not accessing or using our website.

For Users Outside of the United States Only

The Service is hosted on servers located in the United States. If you are a user accessing the Service from the European Union, Australia, Asia, or any other region with laws or regulations governing personal data collection, use, and disclosure, that differ from United States laws, you are transferring your personal data to the United States which may not have the same data protection laws as such other regions. By providing user information through the Service you are consenting to the transfer of your information to the United States for processing and maintenance in accordance with this Privacy Policy and the User Terms. Ads appearing on our website may be delivered to Users by advertising partners, who may set cookies. LEGAL DISCLAIMER

This Service operates "AS-IS" and "AS-AVAILABLE," without warranties of any other kind. We are not responsible for events beyond our direct control. This Privacy Policy is governed by the laws of the State of California, excluding conflicts of law principles. Any legal actions against us arising out of or related to the Service must be commenced in the county of Los Angeles in the state of California in the United States of America.
